Organic Corpus of Life, Liberty, and the Rule of Law
Preamble
In Liberty and Unity, We the People form a Commonwealth to preserve self-determination under the rule of law, to unite ourselves in the common defense, the administration of justice, the preservation of liberty, and the pursuit of our common welfare. Recognizing that the Sovereignty of the Commonwealth neither originates with nor belongs exclusively to any generation, but is held in perpetual trust across generations, we do ordain and establish this Organic Corpus as the lawful means through which we exercise our collective right to self-determination.
Covenants of Identity
The sovereign Community is hereby constituted as a state of liberty, personal sovereignty, and the rule of law pursuant to this Organic Corpus.
Personhood under this Organic Corpus encompasses every individual member of a species or other class characteristically possessing the capacities for both sentience and sapience, including every human being.
Every Person possesses inherent personal authority pursuant to this Organic Corpus.
Such authority shall remain vested in every Person and shall be exercised only pursuant to this Organic Corpus and lawful Instruments established pursuant thereto.
A Community under this Organic Corpus encompasses every association of Persons possessing or seeking a common territorial jurisdiction.
Every Community possesses the inherent right to constitute itself pursuant to this Organic Corpus.
The sovereign Community may establish the constitutional procedures governing the constitution, recognition, modification, consolidation, division, dissolution, and jurisdiction of Communities pursuant to this Organic Corpus.
No Community shall acquire constitutional jurisdiction except pursuant to those procedures.
Within its constitutionally recognized jurisdiction, every Community may govern its own affairs through its constituting Instrument and may adopt collectively binding Instruments through lawful aggregation proceedings pursuant to this Organic Corpus.
Every constituting Instrument and collectively binding Instrument adopted by a Community shall possess legal force within that Community except to the extent inconsistent with this Organic Corpus.
No exercise of authority shall impair the constitutional self-government of a Community except as authorized by this Organic Corpus and only to the extent reasonably necessary to accomplish a lawful constitutional purpose.
No collectively binding Instrument shall possess legal force beyond the constitutional jurisdiction of the adopting Community except as otherwise provided pursuant to this Organic Corpus.
The sovereign Community consists of every Person born within the territories of the Commonwealth; or lawfully domiciled within its territories pursuant to this Organic Corpus. The sovereign Community constitutes the collective expression of the personal sovereignty vested in its members pursuant to this Organic Corpus.
The sovereign Community alone possesses plenary constitutional authority respecting every jurisdiction established pursuant to this Organic Corpus.
Such authority shall remain vested in the sovereign Community and may be exercised directly or through proxies lawfully constituted pursuant to this Organic Corpus.
Membership in the sovereign Community shall continue unless voluntarily relinquished or lawfully revoked pursuant to this Organic Corpus.
No membership shall be revoked except upon a final judicial determination that the membership was procured through material fraud; or the Person has unequivocally repudiated membership through conduct expressly defined by this Organic Corpus as grounds for revocation.
No exercise of authority may lawfully abolish or materially subvert the constitutional order established by this Organic Corpus.
Where no lawful constitutional remedy remains reasonably available, every Person retains the right to resist any exercise of authority that unlawfully abolishes or materially subverts the constitutional order established by this Organic Corpus.
Every Person shall be equal before this Organic Corpus. Every Person shall enjoy, to the greatest extent reasonably practicable, equal rights, liberties, powers, authorities, responsibilities, and lawful interests under this Organic Corpus.
No exercise of authority shall arbitrarily or unjustifiably distinguish among Persons on the basis of any lawful personal characteristic.
Every Person possesses the inherent authority to defend the Person from unlawful Injury.
No exercise of such authority shall employ force greater than is reasonably necessary and proportionate to the threatened Injury.
Every Person possesses inherent dignity and personal integrity pursuant to this Organic Corpus.
Every exercise of authority relating to the dignity or personal integrity of a Person shall preserve the life and bodily integrity of every Person except as otherwise expressly authorized pursuant to this Organic Corpus; respect the dignity and mental integrity of every Person; refrain from arbitrary seizure, detention, confinement, or disappearance; and otherwise preserve the inherent dignity and personal integrity of every Person.
Where the constitutional rights or lawful interests of two or more Persons are necessarily interdependent by reason of unavoidable biological dependency, including pregnancy, every exercise of authority shall preserve, to the greatest extent reasonably practicable, the constitutional rights and lawful interests of every Person affected.
Every such exercise of authority shall employ no greater impairment of constitutional rights or lawful interests than is reasonably necessary to accomplish a lawful constitutional purpose.
Every such exercise of authority shall proceed through lawful, impartial, proportionate, and reviewable procedures.
Nothing in this Article shall be construed to compel a Person to surrender bodily autonomy.
Every Person possesses an equal lawful claim to meaningful, timely, and equitable holistic treatment pursuant to this Organic Corpus.
Every exercise of authority relating to holistic treatment shall preserve meaningful and equitable access to reasonably necessary holistic treatment; respect the dignity, bodily integrity, mental integrity, and informed Consent of every Person; preserve the continuity of reasonably necessary treatment where interruption would foreseeably result in material Injury; employ no greater impairment of constitutional rights or lawful interests than is reasonably necessary to accomplish a lawful constitutional purpose; and remain reasonably appropriate to the condition thereby addressed.
Every Person possesses inviolable personal agency, including the rights of self-determination, expression, and association pursuant to this Organic Corpus. Personal agency includes the freedom to form, hold, express, and peacefully act upon lawful beliefs, relationships, associations, agreements, occupations, and other lawful pursuits consistent with this Organic Corpus.
Every exercise of authority relating to the personal agency of a Person shall preserve the Person’s freedom of self-determination; preserve the Person’s freedom of lawful expression and association; refrain from compelling the Person to act against the Person’s will except as otherwise authorized pursuant to this Organic Corpus; refrain from arbitrarily impairing, suspending, or depriving the Person’s personal agency; and preserve, to the greatest extent reasonably practicable, the Person’s present and future capacity for self-determination.
Where a Person lacks the present capacity to exercise one or more constitutional rights or lawful interests, every exercise of fiduciary authority on that Person’s behalf shall preserve, to the greatest extent reasonably practicable, that Person’s dignity, welfare, present constitutional interests, personal agency, and future constitutional autonomy.
Every Person possesses inviolable integrity respecting the Person’s private affairs pursuant to this Organic Corpus.
Every exercise of authority relating to the private affairs of a Person shall respect the confidentiality, integrity, and security of the Person’s private affairs; encroach upon those private affairs only with the Person’s lawful Consent or pursuant to lawful authority providing sufficient authorization, notice, and opportunity for constitutional contestation except as otherwise expressly provided pursuant to this Organic Corpus; and preserve, to the greatest extent reasonably practicable, the Person’s ability to control the collection, use, disclosure, and retention of information respecting the Person’s private affairs consistent with this Organic Corpus.
Every exercise of fiduciary authority respecting the private affairs of another Person shall be limited to what is reasonably necessary for the faithful discharge of that fiduciary responsibility.
No exercise of authority shall employ indiscriminate, generalized, or mass surveillance or other comparable intrusions except as otherwise expressly authorized pursuant to this Organic Corpus.
Every Person possesses inviolable personal identity pursuant to this Organic Corpus.
Every exercise of authority relating to the identity of a Person shall respect the Person’s lawful identity and self-identification consistent with this Organic Corpus; preserve the authenticity, continuity, integrity, and lawful reputation of the Person’s identity; refrain from arbitrarily denying, compelling, falsifying, misappropriating, or materially misrepresenting the identity of any Person; and preserve the Person’s ability to establish, maintain, and lawfully verify the Person’s identity pursuant to this Organic Corpus.
Every Person possesses inviolable intellectual liberty pursuant to this Organic Corpus.
Every exercise of authority relating to intellectual liberty shall preserve the freedom of every Person to inquire, learn, discover, create, and communicate knowledge and ideas; refrain from arbitrarily compelling, manipulating, suppressing, or restricting intellectual activity or expression; preserve meaningful access to information reasonably necessary for the exercise of constitutional rights, responsibilities, and lawful interests; and otherwise preserve the conditions necessary for the free exercise of intellectual liberty pursuant to this Organic Corpus.
Every Person possesses inviolable social dignity and an equal lawful claim to meaningful participation in the civic, economic, cultural, and social life of the sovereign Community pursuant to this Organic Corpus.
Every exercise of authority relating to social dignity or social participation shall preserve equal opportunity for meaningful participation in the civic, economic, cultural, and social life of the sovereign Community; refrain from arbitrarily discriminating against, excluding, or otherwise impairing the lawful participation or social mobility of any Person; respect the dignity, rights, abilities, and lawful interests of every Person; where a Person lacks the present capacity for independent participation, faithfully discharge every applicable fiduciary responsibility so as to preserve that Person’s present interests and future autonomy; and otherwise preserve the conditions necessary for the equal enjoyment of social dignity and meaningful participation pursuant to this Organic Corpus.
Every Person possesses an inviolable equal beneficial interest in every resource held in common pursuant to this Organic Corpus.
Every exercise of authority relating to resources held in common shall require fair and equitable compensation, stewardship, or other lawful obligation for every exclusive or materially preferential use of resources held in common; and preserve the equal beneficial interest of every Person in those resources.
No exercise of authority shall confer absolute or perpetual dominion over any resource held in common.
Every Person possesses an inviolable right to acquire, hold, enjoy, produce, exchange, and lawfully dispose of proprietary interests and lawfully produced value pursuant to this Organic Corpus.
Every exercise of authority relating to proprietary interests shall preserve lawful proprietary interests and lawfully produced value; provide full and equitable compensation for every permanent deprivation of a lawful proprietary interest; and refrain from imposing compulsory public Exaction solely by reason of the lawful production of value.
Every Person possesses an equal lawful claim to meaningful participation in lawful Exchange pursuant to this Organic Corpus.
Every exercise of authority relating to lawful Exchange shall preserve the freedom of Persons to voluntarily acquire, exchange, and dispose of lawful goods, services, and obligations; refrain from arbitrarily impairing lawful Exchange; and preserve equal opportunity for meaningful participation in lawful Exchange.
Every Community shall secure the safety of every Person within its constitutional jurisdiction pursuant to this Organic Corpus.
Every exercise of authority respecting public safety shall serve only a lawful protective purpose; employ the least coercive means reasonably sufficient to accomplish that purpose; and remain proportionate to the Injury or threat thereby addressed.
Every Community shall provide meaningful, timely, and impartial adjudication respecting every alleged breach of rights, duties, obligations, liabilities, and other legally protected interests arising within its constitutional jurisdiction.
Every exercise of adjudicative authority shall provide every materially affected Person a reasonable opportunity to be heard; determine every matter only pursuant to law and sufficient evidence; impose only lawful and proportionate legal consequences; and remain subject to constitutional review pursuant to this Organic Corpus.
No exercise of adjudicative authority shall impose any judgment, remedy, penalty, liability, obligation, or other legal consequence except pursuant to law, sufficient evidence, and lawful adjudication consistent with this Organic Corpus.
Every such imposition shall be lawful, proportionate, reasoned, and subject to constitutional review.
The sovereign Community may determine the procedures governing collective action and the adoption of collectively binding Instruments pursuant to this Organic Corpus.
Every such procedure shall identify the matter to be determined, the Persons, Communities, or Entities possessing standing to participate, and the constitutional method by which that standing shall be aggregated.
Every such procedure shall prescribe the minimum level of support required to authorize the proposed determination.
Every such procedure shall provide every materially affected participant reasonable notice and a meaningful opportunity to participate and shall provide for verification, certification, auditability, and review where required pursuant to this Organic Corpus.
The sovereign Community may determine the procedures governing the creation and recognition of individually binding Instruments pursuant to this Organic Corpus.
Every such procedure shall identify the Persons, Communities, or Entities possessing standing to participate and the lawful authority under which the Instrument may be created.
Every such procedure shall provide for lawful Consent, reasonable notice, and a meaningful opportunity to participate where required pursuant to this Organic Corpus.
Every such procedure shall provide for the authentication, verification, certification, registration, review, and acquisition of legal force of every resulting Instrument where required pursuant to this Organic Corpus.
A Commonwealth is hereby constituted to act as the public proxy of the sovereign Community in the exercise of public authority.
The exercise of public authority by the Commonwealth shall not prejudice, diminish, or otherwise impair the inherent sovereignty, rights, powers, or prerogatives retained by the People and the sovereign Community pursuant to this Organic Corpus.
All public authority exercised under the Commonwealth shall derive from this Organic Corpus or from lawful Statutory Instruments enacted pursuant thereto.
The sovereign Community alone possesses plenary constitutional authority respecting every jurisdiction established pursuant to this Organic Corpus.
The sovereign Community may constitute public Entities, offices, organs, jurisdictions, and Corpora of the Commonwealth by Statutory Instrument except as otherwise provided by this Organic Corpus.
Every public Entity shall exercise only the authority conferred upon it by this Organic Corpus and its constituting Statutory Instrument.
The ordinary government within the jurisdiction of the Commonwealth shall be administered only through public Entities constituted pursuant to this Organic Corpus.
The constitutional organization of public authority shall preserve the independence, impartiality, and integrity necessary for the faithful discharge of every constitutional responsibility.
No allocation, constitution, consolidation, delegation, administration, or exercise of public authority shall materially impair those constitutional requirements.
No Person or Entity shall exercise public authority in a manner materially incompatible with the independent and impartial accountability required by this Organic Corpus.
Public authority shall be allocated to the most proximate competent public Entity capable of faithfully administering the matter entrusted to it.
Every allocation of public authority shall remain proportionate to the constitutional responsibility thereby entrusted; remain subject to lawful review; and remain consistent with this Organic Corpus.
Every exercise of public authority shall serve a lawful constitutional purpose; employ no greater impairment of any constitutional right, liberty, authority, or other protected interest than is reasonably necessary to accomplish that purpose; and remain within the authority lawfully conferred upon the Entity exercising it.
Every exercise of, or material omission in the exercise of, public authority shall remain subject to constitutional accountability pursuant to this Organic Corpus.
Constitutional accountability shall require independent and impartial review of every material exercise or omission of public authority; the maintenance of records sufficient to permit meaningful review; the lawful investigation of alleged misconduct, abuse, maladministration, or other constitutional Injury; and the availability of lawful remedies where liability is established.
Every Entity constituted or recognized pursuant to this Organic Corpus shall possess legal personality and the right to govern its internal affairs in accordance with its constituting Instrument. No material impairment of an Entity’s legal personality, constituting Instrument, or organizational integrity shall have legal force except pursuant to lawful authority and adjudication consistent with this Organic Corpus.
Every Entity exercising the jurisdiction of the Commonwealth shall be constituted and administered to preserve the constitutional integrity of its jurisdiction. Its structure shall provide for the distribution of authority, institutional independence, lawful oversight, and constitutional accountability to the extent reasonably practicable.
An Adjudicative Corpus is hereby ordained under the Commonwealth. The Adjudicative Corpus shall possess constitutional jurisdiction respecting lawful adjudication; the adjudication of rights, duties, obligations, liabilities, remedies, and other legally protected interests; the review of judgments, orders, determinations, proceedings, and exercises of public authority; the administration of constitutional and statutory justice; and such other matters as may be established pursuant to this Organic Corpus or by lawful Statutory Instrument.
The jurisdiction of the Adjudicative Corpus shall be exercised only through Adjudicative Entities lawfully constituted pursuant to this Organic Corpus.
Every Adjudicative Entity shall faithfully discharge the constitutional responsibilities entrusted to it pursuant to this Organic Corpus. Every such Entity shall issue every material determination through reasoned, impartial, equitable, and proportionate adjudication; state sufficient findings of fact, identify the governing law, and explain the reasoning supporting every material determination; determine materially similar matters consistently except where a lawful distinction or departure is expressly identified and justified; prescribe only such judgments, remedies, and orders as are reasonably necessary and proportionate to the matters determined; preserve sufficient records to permit meaningful constitutional review, appellate review, and public accountability to the extent permitted pursuant to this Organic Corpus; and otherwise preserve every constitutional safeguard applicable to lawful adjudication pursuant to this Organic Corpus.
Adjudicative Entities shall possess only such powers as are lawfully conferred pursuant to this Organic Corpus or by Statutory Instrument. Such powers may include authority respecting the adjudication of constitutional and statutory matters; the issuance of judgments, remedies, declarations, injunctions, and lawful orders; the review of determinations issued by subordinate adjudicative bodies; the enforcement of lawful judgments and orders; the administration of judicial proceedings; or such other adjudicative authority as may be lawfully conferred pursuant to this Organic Corpus.
A Public Safety Corpus is hereby ordained under the Commonwealth. The Public Safety Corpus shall possess constitutional jurisdiction respecting holistic treatment; public safety; public security; constitutional order; the common defense; and such other matters as may be established pursuant to this Organic Corpus or by lawful Statutory Instrument.
The jurisdiction of the Public Safety Corpus shall be exercised only through Public Safety Entities lawfully constituted pursuant to this Organic Corpus.
Every Public Safety Entity shall faithfully discharge the constitutional responsibilities entrusted to it pursuant to this Organic Corpus. Every such Entity shall preserve life, dignity, bodily integrity, and constitutional rights as the principal objects of every exercise of authority; employ prevention, mitigation, treatment, de-escalation, and recovery in preference to coercion wherever reasonably sufficient to accomplish a lawful constitutional purpose; maintain material, procedural, and operational independence between incompatible public safety functions to the extent reasonably necessary to prevent unlawful concentration or misuse of authority; subject every material exercise of coercive authority to complete documentation, independent review, and constitutional accountability; refrain from employing public safety authority to suppress, intimidate, surveil, infiltrate, or otherwise interfere with lawful constitutional activity except where expressly authorized pursuant to this Organic Corpus; maintain sufficient operational, administrative, and technical safeguards to preserve constitutional continuity, civilian constitutional control, lawful interoperability, and resilience; and otherwise preserve every constitutional safeguard applicable to its jurisdiction pursuant to this Organic Corpus.
Public Safety Entities shall possess only such powers as are lawfully conferred pursuant to this Organic Corpus or by Statutory Instrument. Such powers may include authority respecting protective services; holistic treatment; emergency management; investigation; intelligence; civil protection; national defense; or such other authority as may be lawfully conferred pursuant to this Organic Corpus.
Every individual of a species or other class characteristically possessing the capacity for sentience shall constitute a Sentient pursuant to this Organic Corpus.
Every Sentient possesses inherent dignity. The Commonwealth shall provide by law for the humane treatment and protection of Sentients consistent with their capacities, welfare, and natural needs. No law or other exercise of public authority respecting a Sentient shall possess legal force unless it protects the Sentient from arbitrary deprivation of life, unnecessary suffering, and cruel treatment; respects the Sentient’s bodily integrity to the extent reasonably practicable; and and requires any lawful deprivation of life to serve a legitimate purpose and employ humane means reasonably designed to minimize suffering.
Every Ecology shall possess the right to ecological integrity. No law or other exercise of public authority shall materially impair that right except as reasonably necessary to accomplish a compelling constitutional purpose. The Commonwealth shall preserve, restore, and protect the ecological systems upon which life depends.
Upon ratification by the sovereign Community, this Organic Corpus shall constitute the Constitutive Covenants of the Commonwealth. The sovereign Community may enact, incorporate, amend, repeal, consolidate, and otherwise establish Supplemental Covenants pursuant to this Organic Corpus. The Constitutive Covenants shall not be amended or repealed pursuant to this Organic Corpus.
Every Instrument enacted pursuant to a constitutional jurisdiction established by this Organic Corpus shall possess paramount legal force within that jurisdiction, subject only to this Organic Corpus, every applicable Supplemental Covenant, and the Constitutional Doctrine governing their interpretation. No Supplemental Covenant, Constitutional Determination, Instrument, exercise of authority, or other act shall possess legal force to the extent that it is inconsistent with superior constitutional authority.
Constitutional Doctrine shall consist of the authoritative principles, standards, tests, interpretations, and precedents established pursuant to this Organic Corpus for its faithful interpretation and application. Applicable Constitutional Doctrine shall govern the interpretation and application of this Organic Corpus, every Supplemental Covenant, and every Instrument enacted pursuant thereto unless lawfully modified pursuant to this Organic Corpus. Every Person, Community, Entity, and public authority exercising authority pursuant to this Organic Corpus shall remain bound by applicable Constitutional Doctrine.
This Organic Corpus may be superseded only through Constitutional Reconstitution consisting of the lawful ratification of an entire successor constitutional order. No Constitutional Reconstitution shall possess legal force unless approved by the sovereign Community through the highest constitutional concurrence recognized pursuant to the Constitutive Covenants.
Supplemental Covenants
Every collective determination shall be made through a lawful aggregation proceeding conducted pursuant to this Organic Corpus. Every aggregation proceeding shall account for every participant possessing standing respecting the matter to be determined; record the constitutional standing expressed or otherwise attributed to every participant; aggregate that standing according to the constitutional method of aggregation; determine whether the resulting Normalized Score satisfies the applicable minimum Normalized Score prescribed pursuant to this Organic Corpus; and produce a Certification Report respecting the determination.
Constitutional standing in an aggregation proceeding shall consist of the following expressions. Assent, expressing affirmative standing; Dissent, expressing negative standing; Abstention, expressing participation without directional standing; Absent, where standing was required but no expression was made; or Nonparticipating, where standing was not required and no expression was made.
The constitutional method of aggregation shall assign equal standing to every participant unless otherwise provided by this Organic Corpus; aggregate affirmative and negative standing into a single normalized measure of concurrence; treat Abstention as participation without directional standing; account for Absent and Nonparticipating participants as provided by lawful procedure; and produce a Normalized Score representing the collective concurrence of the aggregation authority.
The Normalized Score shall consist of a normalized measure of collective concurrence ranging from negative one hundred points, representing unanimous Dissent, to positive one hundred points, representing unanimous Assent, with zero representing complete constitutional neutrality.
No collective determination shall possess legal force unless the resulting Normalized Score satisfies or exceeds the applicable minimum Normalized Score prescribed pursuant to this Organic Corpus; the applicable requirements of procedural legitimacy have been satisfied; Material Uncertainty remains within the constitutional limits applicable to the determination; and the determination has been lawfully certified.
Every minimum Normalized Score shall be prescribed according to the constitutional significance of the matter to be determined. The applicable minimum Normalized Score shall account for the constitutional significance of the determination; its coercive scope; its implications for constitutional continuity; its risk of domination; and its civic impact.
Every collective determination shall be accompanied by a Certification Report. The Certification Report shall identify the aggregation authority, the applicable minimum Normalized Score, the resulting Normalized Score, every finding respecting legitimacy or Material Uncertainty, the Certification Outcome, and such other matters as may be prescribed by lawful Instrument.
The Constitutional Collegium is vested with exclusive authority under the Commonwealth to exercise the constitutional prerogative of proposing, drafting, and revising Constitutional Instruments, without prejudice to the inherent right of popular initiative.
The Constitutional Collegium shall consist of delegates apportioned among the recognized Communities of the sovereign Community according to population and appointed by those Communities pursuant to lawful procedures established under this Organic Corpus.
Only Persons who are members and residents of the appointing Community shall be eligible for appointment as delegates. Every delegate shall remain a resident of the appointing Community throughout the delegate’s appointment.
Constitutional Instruments shall be proposed through the following process pursuant to this Organic Corpus. Every member of the sovereign Community may inquire into, discuss, propose, or petition for Constitutional Revisions. Every proposal shall be received, recorded, and made available for public consideration pursuant to lawful procedures established under this Organic Corpus. The Constitutional Collegium shall deliberate upon, combine, divide, amend, revise, consolidate, and otherwise refine Constitutional Proposals. The Constitutional Collegium shall faithfully synthesize the matters presented into one or more Constitutional Proposals for consideration by the sovereign Community. Every Constitutional Proposal shall be submitted for constitutional concurrence pursuant to this Organic Corpus. Every Constitutional Revision shall acquire legal force only upon satisfying the concurrence requirements established by this Organic Corpus.
The Constitutional Collegium shall possess the constitutional authority necessary to prepare Constitutional Instruments pursuant to this Organic Corpus. receive Constitutional Proposals; conduct hearings, inquiries, and deliberations respecting Constitutional Proposals; combine, divide, amend, revise, consolidate, and otherwise refine Constitutional Proposals; publish draft Constitutional Instruments and explanatory reports; establish procedures governing constitutional proposal proceedings; convene emergency proceedings where immediate constitutional action is reasonably necessary; submit Constitutional Instruments for constitutional concurrence pursuant to this Organic Corpus; and exercise every other authority reasonably necessary for the faithful discharge of its constitutional responsibilities pursuant to this Organic Corpus.
The Jurisprudential Collegium is vested with exclusive authority under the Commonwealth to exercise the constitutional prerogatives of technical legislative drafting, constitutional adjudication, constitutional interpretation, and representative democratic oversight. The Jurisprudential Collegium shall consist of the Peritium, the Jurisprudium, and the Chamber of Representatives.
The Peritium shall consist of a single Panel composed of Members possessing demonstrated public expertise. Members shall be selected pursuant to lawful qualifications established under this Organic Corpus. Where multiple qualified candidates satisfy the applicable qualifications and no materially relevant distinction justifies preference among them, selection shall be determined by lawful sortition. Members shall hold office for life, subject to Technical Fitness Review at intervals not exceeding five years pursuant to lawful procedures established under this Organic Corpus. Members may be removed only through lawful Removal Proceedings affording due process pursuant to this Organic Corpus. The Peritium may establish, merge, divide, reorganize, and retire Boards of Expertise.
Constitutional qualifications and selection procedures for Members of the Peritium shall be established by the sovereign Community pursuant to this Organic Corpus. The Jurisprudential Collegium may recommend revisions to those qualifications or procedures, which shall acquire legal force only upon approval by the sovereign Community.
Every Member of the Peritium shall faithfully discharge the constitutional responsibilities entrusted to the Chamber. Every Member shall disclose every material conflict of interest. Every Member shall exercise independent technical judgment in good faith. The Peritium shall maintain complete records sufficient for constitutional review and public accountability except where lawful confidentiality is required. Every technical determination shall be founded upon admissible evidence, competent expertise, and reasoned analysis.
The Peritium shall possess the constitutional authority necessary for the faithful discharge of technical governance pursuant to this Organic Corpus. draft Statutory and Regulatory Provisions; establish, reorganize, and retire Boards of Expertise; establish and administer public research institutions and technical facilities; conduct investigations, technical inquiries, and Technical Forums; receive testimony and evidence; prescribe technical standards and competency requirements within its jurisdiction; grant research fellowships, stipends, grants, and endowments; recommend minimum Normalized Scores applicable to Statutory and Regulatory Provisions; and exercise every other authority reasonably necessary for the faithful discharge of its constitutional responsibilities pursuant to this Organic Corpus.
The Jurisprudium shall be composed of seven independent Panels.
Each Panel shall consist of five Members selected pursuant to lawful qualifications established under this Organic Corpus. Every Constitutional Determination shall identify the governing Constitutional Doctrine, findings of fact, and supporting reasoning.
The Jurisprudium shall possess the constitutional authority necessary for the faithful discharge of constitutional adjudication pursuant to this Organic Corpus. hear and determine Constitutional Matters; establish, clarify, modify, harmonize, and overrule Constitutional Doctrine; issue Constitutional Determinations; constitute provisional Constitutional Arbitrator offices; prescribe the jurisdiction, procedures, ethical standards, and evidentiary requirements governing Constitutional Arbitrators; recommend the permanent establishment, consolidation, or abolition of Constitutional Arbitrator offices; publish Constitutional Doctrine and judicial opinions; and exercise every other authority reasonably necessary for the faithful discharge of its constitutional responsibilities pursuant to this Organic Corpus.
The Chamber of Representatives shall consist of a single Panel. Members shall be selected by lawful sortition from among Persons who are members of, and residents within, the Communities they represent. Every Member shall remain a member and resident of the represented Community throughout the Member’s term of office. Members shall serve terms of two years. The number of Members shall remain reasonably representative of the sovereign Community. When a vacancy occurs, a successor Member shall be selected through the same lawful procedure by which the vacating Member was selected.
Constitutional qualifications and selection procedures for Members of the Chamber of Representatives shall be established by the sovereign Community pursuant to this Organic Corpus. The Jurisprudential Collegium may recommend revisions to those qualifications or procedures, which shall acquire legal force only upon approval by the sovereign Community.
Every Member of the Chamber of Representatives shall faithfully discharge the constitutional responsibilities entrusted to the Chamber. Every Member shall disclose every material conflict of interest. Every Member shall exercise independent representative judgment in good faith. The Chamber shall maintain complete records sufficient for constitutional review and public accountability except where lawful confidentiality is required. Every determination shall be founded upon admissible evidence, established facts, and representative deliberation.
The Chamber of Representatives shall possess the constitutional authority necessary to preserve representative democratic oversight pursuant to this Organic Corpus. conduct representative hearings and public inquiries; receive petitions, testimony, and evidence from the sovereign Community; review Ordinary Instruments for democratic legitimacy; affirm, modify, reject, suspend, or remand proposed Constitutional Doctrine; declare Constitutional Review Emergencies; suspend the legal operation of Instruments or exercises of public authority pending constitutional review; ordain, establish, reorganize, consolidate, divide, or dissolve administrative Entities constituted pursuant to this Organic Corpus; publish representative findings and opinions; and exercise every other authority reasonably necessary for the faithful discharge of its constitutional responsibilities pursuant to this Organic Corpus.
Every Ordinary Instrument shall consist of one or more Statutory, Regulatory, Doctrinal, or other provisions established pursuant to this Organic Corpus. The Peritium shall possess exclusive authority to prepare Statutory and Regulatory Provisions. The Jurisprudium shall possess exclusive authority to prepare Doctrinal Provisions. Each Chamber shall independently determine the minimum Normalized Score applicable to matters within its constitutional jurisdiction pursuant to this Organic Corpus. No proposed provision shall acquire legal force unless the applicable minimum Normalized Score has been satisfied. Where an Ordinary Instrument contains provisions originating from more than one Chamber, the completed Instrument shall be assembled into a single constitutional package prior to publication, and each Chamber shall remain solely responsible for the provisions originating within its constitutional jurisdiction. Upon satisfaction of every required minimum Normalized Score, the completed Ordinary Instrument shall acquire legal force immediately upon publication pursuant to this Organic Corpus.
The Jurisprudential Collegium shall exercise only such authority as is lawfully conferred pursuant to this Organic Corpus. The legislative authority exercised by the Jurisprudential Collegium shall be concurrent with, and shall not diminish, the inherent legislative authority of the sovereign Community acting through lawful aggregation proceedings pursuant to this Organic Corpus. Accordingly, the sovereign Community retains the authority to originate, enact, amend, suspend, or repeal any Ordinary Instrument within its constitutional authority pursuant to this Organic Corpus.
A Proceedings and Registry Corpus is hereby ordained under the Commonwealth. The Proceedings and Registry Corpus shall possess constitutional jurisdiction respecting lawful proceedings; legally operative Instruments; constitutional and statutory registries; certification, registration, publication, and authentication of public acts; and such other procedural matters as may be established pursuant to this Organic Corpus or by lawful Statutory Instrument.
The jurisdiction of the Proceedings and Registry Corpus shall be exercised only through Proceedings and Registry Entities lawfully constituted pursuant to this Organic Corpus.
Every Proceedings and Registry Entity shall faithfully discharge the constitutional responsibilities entrusted to it pursuant to this Organic Corpus. Every such Entity shall maintain complete, accurate, authentic, and permanent records respecting every matter entrusted to its administration; preserve the integrity, authenticity, accessibility, and continuity of every registry and constitutional record under its administration; ensure that every Instrument or proceeding requiring certification, authentication, registration, or publication is processed pursuant to lawful procedure; maintain public registries sufficient to preserve legal certainty and meaningful constitutional review except where lawful confidentiality is required; and otherwise preserve every constitutional safeguard applicable to lawful proceedings and public records pursuant to this Organic Corpus.
Proceedings and Registry Entities shall possess only such powers as are lawfully conferred pursuant to this Organic Corpus or by Statutory Instrument. Such powers may include authority respecting the certification, authentication, registration, publication, amendment, and archival of Instruments and proceedings; the administration of public registries and official records; the establishment and administration of procedural requirements governing matters within their jurisdiction; the issuance of certifications, notices, and other official procedural acts; the investigation and correction of errors affecting public records and legally operative Instruments; or such other procedural authority as may be lawfully conferred pursuant to this Organic Corpus.
A Commons, Exchange, and Holdings Corpus is hereby ordained under the Commonwealth. The Commons, Exchange, and Holdings Corpus shall possess constitutional jurisdiction respecting the Commons; lawful Exchange; lawful Holdings; fiduciary interests held pursuant to this Organic Corpus; the stewardship and administration of public assets; and such other matters as may be established pursuant to this Organic Corpus or by lawful Statutory Instrument.
The jurisdiction of the Commons, Exchange, and Holdings Corpus shall be exercised only through Commons, Exchange, and Holdings Entities lawfully constituted pursuant to this Organic Corpus.
Every Commons, Exchange, and Holdings Entity shall faithfully discharge the constitutional responsibilities entrusted to it pursuant to this Organic Corpus. Every such Entity shall preserve and faithfully administer every fiduciary interest entrusted to its care; maintain the integrity of the Commons and every public fiduciary estate; segregate fiduciary responsibilities such that no Person possesses unilateral authority to materially affect any entrusted fiduciary interest except as otherwise provided pursuant to this Organic Corpus; maintain complete and accurate registers, accounts, and records respecting matters entrusted to its administration; preserve constitutional sovereignty over every material public asset and fiduciary repository entrusted to its administration; and otherwise preserve every constitutional safeguard applicable to fiduciary administration pursuant to this Organic Corpus.
Commons, Exchange, and Holdings Entities shall possess only such powers as are lawfully conferred pursuant to this Organic Corpus or by Statutory Instrument. Such powers may include authority respecting the constitution and administration of the Commonwealth Estate and other public fiduciary estates; the recognition, recording, transfer, settlement, valuation, and stewardship of Holdings and Exchanges; the preservation, restoration, remediation, protection, and lawful management of the Commons and other public fiduciary interests; the investigation and pursuit of remedies respecting Injury to public fiduciary interests; the maintenance of public registries and fiduciary records; or such other fiduciary authority as may be lawfully conferred pursuant to this Organic Corpus.
